Terms and Conditions of Contract

Ayrshire Tree Surgeons Ltd North Hourat, Largs Road, Kilbirnie.

The Contractor
Ayrshire Tree Surgeons Ltd (ATS Ltd) agrees to perform the work in a competent manner according to British Standard 3988 and 5837 and in compliance to the specification and quotations contained in the estimate.

All Contracts
All domestic contract and instructions are accepted on the basis of payment in full of the invoice on completion of the works with commercial contract and instructions due within 30 days from the date of issue unless prior arrangements have been agreed. Late payment charges of 5% interest per month will apply to the outstanding amount until payment is received in full.

Notice of Right to Cancel (Cooling off Period)
The customer has 14 days to cancel the contract (in writing) from acceptance date. In the event of cancelation at short notice, costs may be proportionally incurred by the customer.

Amendments
Amendments to the contract must be made in writing.

Complaints
Any complaints which may arise from work must be made within the period of 7 days from the date of invoice, unless agreed in writing to the contrary.

Tree Preservation Orders and Conservation Areas
The trees covered by the Contract may be in a conservation area or be subject to a Tree Preservation Order. It is the customers responsibility to understand the TPO and CA status and to obtain the relevant permissions unless they have requested ATS to undertake this work on their behalf. It is also the responsibility of the client for obtaining a felling licence from Scottish Forestry, Natural Resources Wales or the Forestry Commission (England) if required.

Private Covenants
Investigation of Private Covenants shall be the responsibility of the Owner and no liability shall attach to the Contractor for a breach of any such Covenant

Underground Services
Unless a plan showing the exact location of underground pipes, wires or cables has been forwarded to us by the Owner of the land/customer prior to the formation of the contract the Contractor shall be under no liability for any damage caused as a result of works carried out under the Contract to such pipes, wires or cables, or for any damage to property resulting there from and the owner of the land shall be solely liable for any such damage.

Power Lines or Telephone Cable
Any charge for the removal of power lines or telephone cables is to be the responsibility of the Owner .

Third Party Trees
Where works are proposed to third party trees, i.e. a neighbour’s trees, Ayrshire Tree Surgeons Ltd will require written confirmation from the tree owner (the neighbour) that the works are agreed and where necessary, that access is permitted. If works only apply to overhanging branches that can be pruned from within the client’s property, then permission is not required but the neighbour should be advised where practicable.

Completion of Contract
ATS Ltd will not be liable in damages or otherwise because of non – performance of a Contract due to adverse weather conditions, strikes, war and civil commotion. We retain the right in such circumstances to cancel the Contract in whole or in part. Completion dates shall be contingent upon weather conditions.

Expiry of Quotation
Three months after the submission of the quotation, ATS Ltd reserves the right to withdraw and re-quote for the work, unless otherwise agreed in writing on acceptance of instructions from the Owner.

Hidden Obstructions
Quotations for felling assume that the trees are free from metal, stone or other hidden obstructions. In the event of a tree being impossible to fell in the normal way, ATS Ltd reserves the right to re-quote accordingly.

Stump Grinding
Tree stumps describes the union of the tree with the ground and unless otherwise specified does not included the entire root system. Stumps will be ground away or to minimum depth of 6 inches unless otherwise agreed. Cleaning, back filling and re-turfing can be arranged at  further charge

Site Conditions
The Contract price is based on the site conditions, existing at the time of the preparation of the estimate, remaining unchanged.

Debris/ Arisings
All lengths mentioned are approximate. If the timber is required to be cut to allow for burning then an additional charge will be incurred, unless previously agreed prior to commencing the contract.
If timber is required to be moved away from the base of the tree and stacked in a differing location then, unless previously agreed prior to commencing the contract, an additional charge will be incurred.

Wood chip
All woodchip will be created by the use of a chipper either track mounted, vehicle trailed or tractor mounted. The resulting chips will be either disposed directly onto site or removed from site. If access is unavailable, chips will be deposited as close to designated area as possible.

Insurance Cover
All work carried out by ATS Ltd is covered by a £10,000,000 Third Party and Public Liability Insurance for damage to persons or property that may result from the implementation of the Contract.  ATS Ltd carries a further £5,000,000 in Professional Indemnity insurance in respect of Tree Reports.
